Political and legal observer Boni Hargens believes that the transfer of the handling of the alleged coal corruption case from the National Police to the Attorney General's Office is a tactical move to prevent clashes between law enforcement agencies.
In his statement in Jakarta on Friday, Boni said that this step was a rational mechanism to avoid clashes between law enforcement agencies that could disrupt the law enforcement process.
"In this context, the importance of maintaining institutional harmony between the National Police and the Attorney General's Office is more pressing than rigid procedural compliance," he said.
According to Boni, the difference between transferring files and submitting files for further investigation is not just a matter of terminology, but also concerns jurisdiction, legal responsibility, and the validity of the prosecution process.
He said the difference in perspectives reflected the tension between formal legality and practical effectiveness in the Indonesian legal system.
