Criminal law expert Hery Firmansyah reminded that the Draft Law on Amendments to Law Number 8 of 1981 concerning Criminal Procedure Law drafted by the Indonesian House of Representatives can protect and respect human rights in law enforcement in the country.
"How can we then design a Criminal Procedure Code that protects and respects human rights? This is something we certainly need to consider," he said at the Parliament Complex, Senayan, Jakarta, Tuesday.
He conveyed this in a legislative forum discussion entitled "DPR's Commitment to Strengthening Criminal Law through Discussion of the Criminal Procedure Code Bill" held by the Parliamentary Journalist Coordinator (KWP) together with the DPR RI News Bureau.
Because, he said, the old Criminal Procedure Code actually accommodated more of the rights of perpetrators of criminal acts, while the rights of victims were limited to just one article.
The lecturer at the Faculty of Law, Tarumanegara University, also said that the articles in the old Criminal Procedure Code only accommodated the rights of victims, namely regarding compensation.
"The rest of it doesn't talk about the rights of the victims," he said.
For this reason, he hopes that the Indonesian House of Representatives can oversee this aspect in the discussion of the Criminal Procedure Code Bill currently being discussed in parliament.
He also emphasized that the Criminal Procedure Code Bill should not only talk about speed in handling a case, but also justice for all parties.
"So we and our friends in the DPR hope that we can oversee this matter, which can talk more about due process of law , not only talking about handling cases quickly ( speedy trial ), but also fair trial ," he said.
On the other hand, he encouraged the DPR together with the Government to integrate and accommodate the legal interests of many parties in the preparation of the Criminal Procedure Code Bill, including prioritizing aspects of meaningful public participation .
"Because the legal regulations must be firm and clearly regulate it because this criminal concept speaks of lex certa , lex scripta and kex stricta and cannot be interpreted otherwise, it must regulate it firmly," he said.
