Legal expert: Garut people's party incident could be subject to Article 359 of the Criminal Code




Trisakti University criminal law expert Azmi Syahputra stated that Article 359 of the Criminal Code could be applied in the incident involving the wedding party of an official's child which resulted in three deaths and nine people being treated in hospital.

"Article 359 of the Criminal Code can be applied to the organizing committee and those responsible for the event in question," he told ANTARA on Sunday.

Article 359 of the Criminal Code states "Anyone who, due to his mistake (negligence), causes the death of another person, shall be punished by a maximum imprisonment of five years or a maximum imprisonment of one year."

He explained that the incident in criminal law is called negligence so that the police must ask for information and examine in their investigation starting from the Event Organizer (EO) who organized it in collaboration with the Garut regional government, including elements of the Satpol PP, Dishub personnel, and members of the Police, who were part of the committee "including the organizing permit letter."

So, he said, it is clear that it is reasonable to suspect that the EO and the committee were negligent, unable to anticipate and the organizing committee made mistakes in not thinking things through or were careless.

"The committee was unable to control the situation, thus neglecting the safety of the residents who came to the location. The committee and event organizers acted less cautiously, resulting in injuries to dozens of visitors and even three deaths," he said.

Here, he mentioned that the element of negligence was fulfilled in the causal relationship between the attitude, the condition known from the fact that there was no anticipation, or a careful attitude from the committee with the impact that has now arisen in this case, there are victims.

It was previously reported that the incident that resulted in three people dying at the people's party was part of a series of events at the wedding of the Deputy Regent of Garut, Luthfianisa Putri Karlina, with Maula Akbar, the son of the Governor of West Java, Dedi Mulyadi.

The riot resulted in 26 people being hospitalized and three deaths. Among them was an eight-year-old girl named Vania Aprilia, a resident of Sukamentri Village, Garut City District.
