Mexico City, October 28.- Claudia Irene Gámez Galindo, acting secretary of the Seventh District Court in the State of Mexico , called on the federal government to begin a Covid-19 vaccination plan within five days at the latest , which would include all adolescents aged 12 to 17 to receive the vaccine, regardless of their health status .
On October 7, Gámez Galindo granted a definitive suspension with general effects , ordering the federal government to add to or update the national vaccination policy to inoculate minors under 18 years of age against the coronavirus, between July 2021 and March 2022, since he considered that this age group is at high risk of contagion from the Delta variant .
Abuse of authority
In her ruling, the official warned that if the court order was not complied with, the federal government would be committing the crime of " abuse of authority " and would report the contempt to the Attorney General's Office .
He added that if health authorities issue an internal agreement ordering them to refrain from receiving promotions, lawsuits, injunctions, or requests for this injunction, they will be notified via institutional emails.
If notification is accepted via this method, the clerk will go to the headquarters of the department to draw up a report, record the public servants' refusal, and consider the notification to have been made.
Individual or collective protection
La Jornada reported that due to the return to in-person classes in basic education, parents continue to process hundreds of individual or collective appeals in Mexico City and the State of Mexico, Nuevo León, Oaxaca, Baja California , Tamaulipas, Puebla, Sinaloa, Durango, San Luis Potosí, and other states, so that the federal government can vaccinate their children.
Courts across the country receive an average of up to 200 appeals per day , filed by guardians, groups, or non-governmental organizations. As of October 8, 4,613 injunctions had been filed against the Ministry of Health seeking to have the COVID vaccine administered to minors under 18 years of age.
In 1,747 lawsuits, judges denied the right to vaccinate minors.
