The Ministry of Human Rights is targeting completion of the Presidential Regulation on the Implementation of Business Actor Compliance Assessments on Business and Human Rights next year.
Deputy Minister of Human Rights, Mugiyanto, said that this presidential regulation is part of the government's efforts to introduce human rights due diligence regulations, as mandated in the United Nations Guiding Principles on Business and Human Rights.
"Our regulations regarding business and human rights are in the form of a presidential regulation on business compliance with human rights. Hopefully, it will be issued next year," Mugiyanto said.
He explained that once the presidential regulation has been ratified, the Ministry of Human Rights will conduct outreach in 2026. The following year will focus on technical assistance until finally, in 2028, the government will require every business actor to implement it.
This Presidential Regulation is a continuation of Presidential Regulation No. 60 of 2023 concerning the National Strategy (Stranas) for Business and Human Rights. The difference is that while human rights due diligence in the National Strategy for Business and Human Rights is voluntary , this Presidential Regulation will be mandatory .
"But we're not making it mandatory right away . There are stages involved because this is something new. We need to inform our business partners first," said Mugiyanto.
This Presidential Decree is expected to ensure more sustainable business. According to Mugiyanto, it is inevitable that businesses must be regulated to respect human rights.
He highlighted businesses with low levels of human rights compliance, not only in the private sector but also in state-owned enterprises. Therefore, the Presidential Decree on Business and Human Rights Compliance Assessment will be applied to all types of companies with approximately 2,000 employees.
"This will also ensure legal certainty for them (business actors), and this will reduce their business problems," said the Deputy Minister of Human Rights.
