"The defendant was legally and convincingly proven to have committed a military crime in the line of duty by intentionally hitting a subordinate or in another way injuring him and causing his death, which was done together," said Chief Judge Major Chk Subiyanto at the follow-up hearing of the Prada Lucky case with the agenda of reading the verdict on case Number 40-K/PM.III-15/AD/X/2025 with the defendant Danki A Yonif TP 834/WM Lettu Inf Ahmad Faisal at the III-15 Kupang Military Court, East Nusa Tenggara, Wednesday evening.
In its verdict, the panel of judges sentenced the defendant, Lieutenant Faisal, to a principal sentence of 8 years imprisonment minus the temporary detention period and imposed an additional sentence of dismissal from military service.
The panel of judges also ordered the defendant to pay restitution to the family of the late Prada Lucky Namo in the amount of IDR 561 million.
The panel of judges referred to paragraph 1 in conjunction with paragraph 3 of the Military Criminal Code (KUHPM) in conjunction with Article 55 paragraph 1 point 1 of the Criminal Code (KUHP), which regulates abuse by the military against subordinates.
The verdict was lighter than the demands of the Military Prosecutor who demanded that the defendant be sentenced to 12 years in prison for the main sentence minus the temporary detention period and additional punishment in the form of dismissal from military service, as well as a restitution penalty of Rp. 561 million.
