 Tijuana, September 9.- In Baja California, a total of 293 women have been prosecuted by justice authorities for having terminated their pregnancies from 2016 to July 2021, according to data from the country's National Public Security System.

Women whose criminal cases for abortion remain active will be able to avoid any criminal prosecution following the Supreme Court's ruling, which declared it unconstitutional to consider abortion a crime, said criminal lawyer Fernando Benítez.

"If it's a crime but I can't punish you for committing it, then what will the practical effect be? What if you're being prosecuted, the case will be dismissed. That is, it ends without a sentence because nothing useful will come out of that process because you won't be able to be constitutionally punished for having committed that act," said criminal lawyer Benítez.

No women arrested for having abortions in BC

According to state prison authorities, there is no record in Baja California of women detained for terminating their pregnancies, but if women are detained for abortion in other states, they will have to be released, the lawyer explained.
