Mexicali, August 5.- Representative Liliana Michel Sánchez Allende presented a reform initiative that adds Article 222 Ter to the Penal Code for the State of Baja California to punish patrimonial violence through the concept of domestic fraud.
She indicated that legislation has advanced in the recognition of the various types of violence, including patrimonial violence; however, there is no sanction for such conduct in the local legal framework. In order to impose a penalty for a particular conduct, there must be a legal provision for the conduct called domestic fraud to be classified in the local code, as recommended by the National Commission for the Prevention and Eradication of Violence against Women (Conavim).
The legislator stated that the initiative was inspired by the proposals to address the Gender Violence Alert against Women, analyzed during the Third Working Group of the Strategic Plan "For a Baja California Free of Violence," of the Sixteenth Conclusion of the Working Group's report, which refers to the criminalization of family fraud, to address the request for a Gender Violence Alert against Women for the State.
He emphasized that the objective of creating the crime of domestic fraud is to address the patrimonial violence generated by this social phenomenon, which primarily affects the assets and property of women and their children. Thus, its modification would result in reparation of damages, which consists of a generic obligation on the offender to restore things to the state prior to the events and compensate for the damages caused by the crime.
