Kenya: Abortion rights overturned by an appeals court

In Kenya, an appeals court on Friday overturned a ruling that upheld the right to abortion.


The judges stated that abortion deprives a child of the right to life as guaranteed by the Constitution and is prohibited, except in circumstances such as when the mother's life is in danger.


This is in stark contrast to the High Court, which in 2022 ruled that access to abortion was a fundamental right guaranteed by the Constitution, declaring the arrest and prosecution of women and healthcare professionals unconstitutional.


The Centre for Reproductive Rights, a human rights organization in Kenya, called the verdict a "setback" and vowed to take the case to the Supreme Court.


The Kenyan penal code criminalizes abortion, imposing a sentence of up to 14 years in prison for attempting or causing an abortion.
