The Financial Services Authority has established a policy regarding pension benefit payments through Decree of the OJK Board of Commissioners Members Number KEP-54/D.05/2026, as a follow-up to the Constitutional Court Decisions.
The OJK stated that it respects the Constitutional Court Decisions Number 139/PUU-XXIII/2025 and Number 164/PUU-XXIII/2025 relating to the payment of pension benefits consisting of severance pay, long service awards, and/or compensation for participants, widows/widowers, or children.
As a follow-up to the decision, the OJK stipulated the Decision of the Members of the OJK Board of Commissioners Number KEP-54/D.05/2026 concerning the Granting of Approval or Policies Different from the Financial Services Authority Regulations Governing the Implementation of Pension Fund Businesses related to the Payment of Pension Benefits for Participants, Widows/Widowers, or Children.
"The issuance of this decision is an exercise of the OJK's authority to provide legal certainty regarding the implementation of the Constitutional Court Decision, while also safeguarding the interests of Pension Fund participants, the continuity of Pension Fund operations, and the stability of the Pension Fund industry," Agus said.
