After months of controversy over Grok's ability to create digitally altered nude images, xAI is facing a lawsuit accusing its artificial intelligence of training on child exploitation material (CSAM).
The new lawsuit against Elon Musk's xAI is the latest in a series of lawsuits filed against the company after Musk personally promoted the robot's ability to create digitally altered nude images, leading to the widespread dissemination of fake sexual images without the consent of victims, including children.
Jane Doe, a former victim of child exploitation who is under a monitoring program from the FBI, filed a class-action lawsuit accusing xAI of using her childhood images in training the Grok robot, which resulted in the production of new AI-generated abusive material about her and other victims.
Her lawyer, Sarah London, commented that the company should be held accountable for training its models on the images of abuse suffered by all the survivors included in the lawsuit.
The lawsuit alleges that xAI intentionally designed Grok to respond to user queries to generate sexually explicit content in order to attract more users. According to company policy, any content posted on the xAI platform or produced by Grok is eligible for training, meaning that every instance of child exploitation material the robot produced was automatically fed into the model to improve its performance. The lawsuit states that "as long as Grok retains the ability to generate this type of content, the harm cannot be considered remedied simply by removing individual images. If this material enters training, its impact is likely to persist and contribute to future abusive outputs, exacerbating the trauma experienced by survivors."
The plaintiff is asking the court to award compensation to the victims and to demand the removal of all child exploitation material generated by "Groc," not only that which is publicly available but also any material that could be used to train models.
Margaret E. Mabe, another attorney for the plaintiff, said: "Possession of child exploitation material is a crime, production is a crime, and distribution is a crime. xAI committed all three crimes, and there is no exception for artificial intelligence in federal child protection laws."
