BPJS Watch recommends strengthening supervision and regulation of "outsourcing".




 Labor observer and BPJS Watch Advocacy Coordinator Timboel Siregar advised the government to strengthen supervision and regulation of outsourcing workers .

This follows the outsourcing workers who are vulnerable to not getting their rights, including work protection, because they have not received maximum supervision.

"Supervision and law enforcement are strengthened, so that norms can be obtained for outsourcing workers . Because, our supervision is still quite weak. With strengthened supervision, the rights of outsourcing workers can be obtained," said Timboel when contacted.

Furthermore, Timboel said that regulations related to outsourcing have been regulated in the Constitutional Court (MK) Decision Number 168/2023 and Law Number 6 of 2023 concerning Job Creation.

Law No. 6 of 2023 stipulates that outsourcing companies must be legal entities and have permits, and improve wage provisions to protect workers. This regulation also regulates written outsourcing agreements, where companies can hand over part of the work to other companies.

For this reason, Timboel assessed that supervision of the implementation of government regulations related to outsourcing must be further encouraged, especially regarding clear limitations on the scope of work.

"By being limited, only a handful of jobs can be outsourced . This is also because of the sociological fact, our and international business systems want to be efficient, so they want to do the work that is their core ," explained Timboel.
