Jampidum emphasized that TPKS cases cannot use restorative justice

 



  Deputy Attorney General for General Crimes  of the Attorney General's Office, Asep Nana Mulyana, emphasized that cases of sexual violence  cannot be resolved through restorative justice  mechanisms.

He said that even though there had been peace and forgiveness between the perpetrator and the victim, it still could not be resolved through restorative justice .

"TPKS is one of the cases that cannot be subject to restorative justice ," said Asep.

To ensure the regulation is implemented, Asep said he has issued a circular to the regions to minimize restorative justice in TPKS cases.

He said that there was a case found related to TPKS which was then resolved by the victim being married to the perpetrator, the problem was considered resolved, even though there were other things that needed attention.

Asep also reminded his staff to ensure that the victims' right to restitution is fulfilled by including it in the criminal charges.

Even during stage II (handing over the suspect and evidence), the prosecutor must provide instructions to investigators to optimize the confiscation of the suspect's assets in order to pay compensation to the victim.

With the judge's decision, the prosecutor will have the legal authority to seize the defendant's assets to give to the victim as restitution.
Previously, the Minister of Human Rights, Natalius Pigai, asked law enforcement officials to process the perpetrator of the alleged confinement and abuse of a woman with the initials YTR (29) in Bandung, West Java, namely Taufik Hidayat, without a restorative justice mechanism .
