Criminal liability proposed for creating or disseminating false information generated with AI


 Mexicali, April 20.- Representative Araceli Geraldo Núñez presented a reform initiative to the Penal Code for the State of Baja California, with the objective of incorporating the use of Artificial Intelligence (AI) as a modality, within the chapter relating to crimes against privacy and image.

The legislative proposal seeks to impose a prison sentence of one to six years and a fine of five hundred to one thousand five hundred times the daily value of the Measurement and Update Unit on anyone who, using AI, manipulates images, audios or videos of intimate sexual content of a person, to create false facts with a real appearance, for the purpose of exposing, distributing, disseminating, exhibiting, etc., without consent.

The document explains that AI uses various algorithms such as "Deep learning," which, based on a large amount of data and numerous layers of algorithmic processing, enables a computer to learn on its own and perform tasks similar to those of humans, such as image identification, natural language processing, and voice recognition, among many other actions.

He added that it is possible to imitate a person's appearance and movements to create content where they appear to be saying or doing things they never did (deepfakes).
