Marina del Pilar used public resources to promote recall referendum: TEPJF


 Tijuana, July 28.- The full court of the Superior Chamber of the Electoral Tribunal (TEPJF) , unanimously confirmed that Baja California Governor Marina del Pilar Ávila Olmeda engaged in campaigning that violated the rules governing recall proceedings . She also misused public funds for this purpose. 

The National Action Party (PAN) filed a complaint against the governor of Baja California for posting a video on her Facebook account, alleging that she violated the rules for promoting and disseminating the recall process, as well as the principle of impartiality for public officials.  

The PAN requested precautionary measures for the governor to remove said promotional material from her social media channels . This request was approved by the local council of the National Electoral Institute in Baja California, which determined that it constituted dissemination of government propaganda during a prohibited period. 

The Superior Court, in a public session via videoconference at the proposal of Judge José Luis Vargas Valdez, decided to uphold the contested judgment, as the Specialized Regional Court fully identified the elements that constituted the violation due to the improper promotion of the recall process, as it expressly requested the call to citizens to participate and vote in the aforementioned democratic participation process.
