 Mexico City, February 6.—Three years before the approval of the 2013 energy reform, the Energy Regulatory Commission (CRE) and the Ministry of Energy (Sener), then headed by Georgina Kessel Martínez—now a board member at Iberdrola—favored private renewable electricity generation companies with the cost of energy transportation or shipping, according to official documents.

Resolution RES/066/2010, issued by the regulatory body, which was chaired by Francisco Xavier Salazar Diez de Sollano –now a partner in a consultancy specializing in the natural gas sector–, indicates that Sener requested the Federal Commission for Regulatory Improvement (Cofemer) that the methodology by which charges were determined for transmission services for renewable or cogeneration source permit holders be exempt from the Regulatory Impact Statement (MIR).

The procedure did not complete its regulatory review—required for modifications and corrections—despite various observations made by the Ministry of Finance and Public Credit (SHCP) during Felipe Calderón Hinojosa's six-year term. It was approved by the CRE, headed by Salazar Diez de Sollano, one of the authors of the 2013 energy reform.

The CRE acknowledged in the resolution that in SHCP document 349-A-0224, notes were made, such as that the methodology presented by the regulatory body only referred to "portage" services, but not to others such as "frequency regulation" and "voltage regulation."
